Authored by State Senator Sasha Pérez, SB 1095 (Expose Data Deportation Centers Act) would protect the privacy and constitutional rights of Californians by limiting how state-operated "Fusion Centers" collect and share sensitive personal information and by increasing transparency and oversight. California is home to six data deportation centers, or "Fusion Centers," which have spied on people engaged in First Amendment-protected activities and circumvented local and state sanctuary and privacy laws. To protect the fundamental rights and freedoms of all who call California home, SB 1095 would prohibit Fusion Centers from sharing sensitive personal information with out-of-state agencies and private entities for the purposes of immigration enforcement without a judicial warrant. It would also promote transparency, oversight and accountability by authorizing local and state elected officials to enter and inspect the centers and requiring an annual audit to ensure compliance with state law.
